Special rules apply to staff who are considered “night workers”. A staff member will be considered a “night worker” if they normally work at least 3 hours of their working time at night time and their number of hours worked between 00h00 and 7h00 in each year equals or exceeds 50% of the total hours worked during that year.

Maximum working hours per day for a night worker is 8 hours on average over a reference period of 8 weeks. This means that the employee can work over 8 hours on a day so long as the daily average working time (over a consecutive 8-week period) does not exceed 8 hours per day. If an employee is identified as a special category night worker arising from a health and safety assessment, maximum working hours must never exceed 8 hours in any day.

Maximum working hours per week for a night worker is 40 hours.
