Posted workers are subject to certain minimum conditions of employment as set out by the Portuguese Labour Code and the relevant collective bargaining agreement with regard to:
working time;
minimum wage and salary payments;
equal treatment and non-discrimination;
permitted age of workers;
health and safety regulations;
non-discrimination of temporary and part-time workers;
respect for privacy and due consideration for the dignity of workers;
free unionisation and rights to strike and assemble.
Any failure to respect such minimum conditions during postings in Portugal, regardless of the legislation applicable to the employment contract, may result in administrative fines by the Portuguese labour authorities
The Portuguese rules on minimum wage and holidays are not applicable if the posting does not exceed eight days.
