For the duration of any posting, the employer must have the following documentation available electronically or at the place of work in Portugal:

  • Employment contracts or specific information about the essential terms of each posted worker’s employment contract;

  • Each posted worker’s payslips or receipts of salary payments;

  • Registration of working hours, indicating the start, end, and duration of every working day;

  • Proof of authorisation of third-country citizens to work under the legislation of the EEA member state of establishment;

  • A1 certificate (see social security requirements above).

Even after the posting has ended, the employer must provide the above-mentioned documentation to the Portuguese labour authorities on request. All the above documentation must be provided in Portuguese or accompanied by a certified translation into Portuguese.

Failure to present the above documentation to the Portuguese labour inspectorate is considered a serious offence under Portuguese law and may be punished accordingly.
